What are complex personal injury compensation claims?

Complex personal injury compensation claims typically mean that liability or the seriousness of the injuries raises a number of complexities that are unusual in straightforward cases. From a liability perspective, this could mean that there may be something of a “grey area” in respect of firmly establishing that an organisation has completely breached the law and is negligent and responsible for an injury that has occurred. It may be that a split liability decision has to be made with liability apportioned between both a claimant and a defendant. In some cases, there are arguments of “contributory negligence” that can mean that a claimant may lose a percentage of their damages for being partially at fault for an accident or injury that has been caused.

In respect of injuries, a complex personal injury matter is commonly about the extent and severity of any suffering that has been caused. Someone who has suffered nerve damage, significant scarring, a brain injury, or significant skeletal or muscular damage could fall into this category. In essence, a case of this nature may mean that the accident victim requires considerable treatment and surgery, and may require medical help over a long period of time. This needs to be carefully managed as part of the case process to make sure that the claim is not settled too early before the extent of an injury could be fully understood or realised. This is why, in some cases, we are able to pursue interim payments which are early part payments to help a claimant before a case fully settles.
